This Privacy Policy describes how Mega Cash Luxe Lending, a division of Mega Cash Pty Ltd ("we", "us" or "our"), collects, uses, holds and discloses personal information when you visit or use https://www.megacashluxe.com.au/ (the "Site"), submit an enquiry, or otherwise communicate with us, and — where an enquiry proceeds to an in-person asset assessment or a completed loan — when you visit our premises or enter into a transaction with us (collectively, the "Services").

We are committed to protecting your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Where an enquiry through this Site leads to an asset-backed loan, we also collect, hold and disclose information in accordance with mandatory requirements under the Pawnbrokers and Second-hand Dealers Act 1996 (NSW) and the Pawnbrokers and Second-hand Dealers Regulation 2021 (NSW).

What Personal Information We Collect (APP 3)

The personal information we collect depends on how you interact with us:

  • Enquiry and contact details. Your name, phone number, email address, location, and your preferred method of contact.
  • Asset and loan information. The type of asset you are enquiring about, its estimated value, your desired loan amount, how quickly you need funding, a description of the asset, and any photos or supporting documents you choose to upload with your enquiry.
  • Identification and transaction information. If your enquiry proceeds to an in-person assessment or a completed loan, we are required to collect identification documents such as your driver licence, passport, Medicare card or proof of age card, along with the relevant ID numbers and expiry dates, and any other information required under NSW pawnbroking legislation.
  • CCTV footage. If you visit our premises, CCTV footage is captured for security and safety purposes.
  • Website usage information. Standard technical information such as your IP address, browser and device details, and the pages you view on the Site, collected via analytics tools such as Google Analytics.

How We Collect Personal Information

We collect information directly from you when you submit an enquiry through the Site, when you communicate with us by phone or email, and — if your enquiry proceeds — when you visit our premises for an asset assessment or transaction, including information we are required to collect under NSW pawnbroking legislation and CCTV footage recorded on-site. We also automatically collect website usage information when you browse the Site.

Why We Collect and Use Your Personal Information (APP 6)

  • To respond to your enquiry and assess whether your asset may be suitable for asset-backed lending.
  • To discuss and provide a funding option, and to complete a transaction if you choose to proceed.
  • To verify your identity, in line with our obligations under NSW pawnbroking legislation.
  • To comply with the Pawnbrokers and Second-hand Dealers Act 1996 (NSW) and its Regulation, including uploading required transaction data daily to NSW Police.
  • To prevent fraud and theft, and to maintain safety and business records.
  • To process payments, including via EFTPOS.
  • To send you marketing communications, but only where you have given your consent.

Disclosure of Personal Information (APP 6 & APP 8)

We may disclose personal information to:

  • NSW Police, through mandatory daily uploads required for completed pawnbroking transactions.
  • Payment processors, for the purpose of processing payments.
  • Technology and service providers who help us operate this Site and respond to your enquiry, such as our website hosting and email providers.
  • Law enforcement agencies and NSW Fair Trading, where legally required.

We do not sell your personal information to third parties for their own marketing purposes.

CCTV Surveillance

CCTV operates at our premises for security, safety and crime prevention purposes. Footage may be provided to NSW Police where required by law.
